Can't ban violent video sales to kids, court says (AP)
WASHINGTON ? States cannot ban the sale or rental of ultraviolent video games to children, the Supreme Court ruled Monday, rejecting such limits as a violation of young people's First Amendment rights and leaving it up to parents and the multibillion-dollar gaming industry to decide what kids can buy.
The high court, on a 7-2 vote, threw out California's 2005 law covering games sold or rented to those under 18, calling it an unconstitutional violation of free-speech rights. Writing for the majority, Justice Antonin Scalia, said, "Even where the protection of children is the object, the constitutional limits on governmental action apply."
Scalia, who pointed out the violence in a number of children's fairy tales, said that while states have legitimate power to protect children from harm, "that does not include a free-floating power to restrict the ideas to which children may be exposed."
Justices Stephen Breyer and Clarence Thomas dissented from the decision, with Breyer saying it makes no sense to legally block children's access to pornography yet allow them to buy or rent brutally violent video games.
"What sense does it make to forbid selling to a 13-year-old boy a magazine with an image of a nude woman, while protecting the sale to that 13-year-old of an interactive video game in which he actively, but virtually, binds and gags the woman, then tortures and kills her?" Breyer said.
Video games, said Scalia's majority opinion, fall into the same category as books, plays and movies as entertainment that "communicates ideas ? and even social messages" deserving of First Amendment free-speech protection. And non-obscene speech "cannot be suppressed solely to protect the young from ideas or images that a legislative body thinks unsuitable for them," he said.
This decision follows the court's recent movement on First Amendment cases, with the justices throwing out attempts to ban animal cruelty videos, protests at military funerals and political speech by businesses.
The court will test those limits again next session when it takes up a new case involving government's effort to protect children from what they might see and hear. The justices agreed to review appeals court rulings that threw out Federal Communications Commission rules against the isolated use of expletives as well as fines against broadcasters who showed a woman's nude buttocks on a 2003 episode of ABC's "NYPD Blue."
The decision to hear the FCC case was one of the last the full court made this session. Before leaving on their annual summer break on Monday, the justices also:
? Voted 5-4 to strike down a provision of a campaign financing system in Arizona that gives extra cash to publicly funded candidates who face privately funded rivals and independent groups.
? Agreed to hear arguments in the fall or winter on whether police need a warrant before using a global positioning system device to track a suspect's movements.
? Refused to hear an appeal from former detainees at the Abu Ghraib prison in Iraq who wanted to sue defense contractors over claims of abuse.
More than 46 million American households have at least one video-game system, with the industry bringing in at least $18 billion in 2010. The industry has set up its own rating system to warn parents which video games are appropriate for which ages, with the rating "M" placed on games that are considered to be especially violent and only for mature adults.
That system is voluntary, however. California's 2005 law would have prohibited anyone under 18 from buying or renting games that give players the option of "killing, maiming, dismembering, or sexually assaulting an image of a human being." Parents would have been able to buy the games for their children, but retailers who sold directly to minors would have faced fines of up to $1,000 for each game sold.
That means that children would have needed an adult to get games like "Postal 2," the first-person shooter by developer Running With Scissors that includes the ability to light unarmed bystanders on fire. It would also apply to the popular "Grand Theft Auto" games, from Rockstar Games, that allow gamers to portray carjacking, gun-toting gangsters.
The California law never took effect. Lower courts have said that the law violated minors' constitutional rights, and that California lacked enough evidence to prove that violent games cause physical and psychological harm to minors. Courts in six other states, including Michigan and Illinois, reached similar conclusions, striking down similar bans.
Video game makers and sellers celebrated their victory, saying Monday's decision puts them on the same legal footing as other forms of entertainment. "There now can be no argument whether video games are entitled to the same protection as books, movies, music and other expressive entertainment," said Bo Andersen, president and CEO of the Entertainment Merchants Association.
But the battle may not be over. Leland Yee, a child psychologist and California state senator who wrote the video game ban, told The Associated Press Monday that he was reading the dissents in hopes of finding a way to reintroduce the law in a way that would be constitutional.
"It's disappointing the court didn't understand just how violent these games are," Yee told the AP.
Thomas argued in his separate dissent that the nation's founders never intended for free speech rights to "include a right to speak to minors (or a right of minors to access speech) without going through the minors' parents or guardians."
And at least two justices, Chief Justice John Roberts and Justice Samuel Alito, indicated they would be willing to reconsider their votes under certain circumstances. "I would not squelch legislative efforts to deal with what is perceived by some to be a significant and developing social problem," Alito said, suggesting that a narrower state law might be upheld.
States can legally ban children from getting pornography. But Scalia said in his ruling that, unlike depictions of sexual conduct, there is no tradition in the United States of restricting children's access to depictions of violence. He noted the violence in the original depictions of many popular children's fairy tales such as Hansel and Gretel, Cinderella and Snow White.

"Certainly the books we give children to read ? or read to them when they are younger ? contain no shortage of gore," he said.
And there is no proof that violent video games cause harm to children, or any more harm than another other form of entertainment, he said.
One doctor "admits that the same effects have been found when children watch cartoons starring Bugs Bunny or the Road Runner or when they play video games like Sonic the Hedgehog that are rated `E' or even when they `view a picture of a gun," Scalia said.
Tim Winter, president of the Parents Television Council, said the decision created a constitutionally authorized "end-run on parental authority."
"I wonder what other First Amendment right does a child have against their parents' wishes?" he said. "Does a child now have a constitutional right to bear arms if their parent doesn't want them to buy a gun? How far does this extend? It's certainly concerning to us that something as simple as requiring a parental oversight to purchase an adult product has been undermined by the court."
The case is Brown v. Entertainment Merchants Association, 08-1448.

Making money online requires a number of skills. These skills are not complex skills, but they are required skills. Without these skills, making money online is practically impossible.
Sadly, nearly all online marketers never discover these skills, for whatever reason. Some have no wish to learn the skills, they are apparently hoping somehow, to generate a quick buck. While others fail to find a mentor willing to teach them these easy, step by step skills.
Most new online marketers simply jump from program to program to program, never make a cent, throw in the towel, and leave the internet forever screaming scam, scam.
However, if you have a strong desire to make money online, and you?re willing to be taught a few new skills, you can be successful. These skills are not complex skills. They are easy to learn. In fact, if you can drive a car, you can learn these basic online marketing skills.
What are these essential skills?
This first skill is not a skill as such, it is essentially a mindset, an inner desire. You need the desire to help others. Any enterprise, whether online or offline, is only as successful as its capability to supply the wants and needs of its customers. Think about this, if Sears was not persistently supplying the goods their customers desire and need, would they have remained in business for more than 100 years?
The next skill is an understanding of the inner workings of the internet. The internet was originally designed to exchange information. It was not meant to be a sales tool. You need to know what a clickable link or image is. You need a basic understanding of uploading and downloading, an FTP client, and an html editor.
In addition, you need a knowledge of traffic generation. That traffic generation can be through ads, writing articles, social media, pay per click advertising, and many other methods.
And then, you need a simple understanding of sales and marketing. Most people are under the assumption sales and marketing are one in the same. Nothing could be further from the truth. Sales and marketing are two separate and distinct functions. Marketing is the process of creating a connection with, and educating the prospect. In other words, making the prospect feel confident and comfortable in making the purchase. Then, and only then, can a sale take place, which is the exchange of money for the product.
Which brings us to the final skill ? product creation. If a business has no product, it has no sales. If a business has no sales, it is out of business. Most products created and sold online are digital products. However, tangible products can also be marketed and sold online as well.
This may all be quite intimidating to a new online marketer.
However, one method of online marketing requires no online marketing skills, apart from how to drive traffic. This method is known in the industry as affiliate marketing, and many very successful online marketers begin their careers as affiliate marketers. In affiliate marketing, you are simply selling someone else?s product. You then receive a commission for each sale.
No matter if you?re brand new to online marketing, or you?ve been struggling to make money online for years, affiliate marketing is a very simple method you can plug into and start making money online very quickly.

This next-generation Humvee was picked by online voters, funded by Department of Defense (Yahoo! News)
The iconic Humvee has had a long and storied history as one of the United States military's go-to vehicles, but times have changed since its 1984 debut. As with all wartime tech, evolution is key to staying ahead of the enemy, and with that in mind, the Defense Advanced Research Projects Agency (DARPA) called for plans to be submitted for a next-generation military vehicle. Fourteen weeks ago, the agency settled on a design called the?FLYPMode, and now it's a reality.
The FLYPMode was chosen out of a pool of over 150 viable designs that were submitted to the auto engineers at Local Motors. The concepts?were submitted by various businesses, designers, and car lovers. After the community picked the winning blueprint ? which netted the lucky designer a $7,500 prize from DARPA ? it was up to?Local Motors to take it from paper to pavement. They did just that, putting the total timeframe between request and prototype at just 1/5th of current defense contractor efforts.
The vehicle sports super-bright LED headlights, massive 35" tires, and a 430-horsepower V8 engine. The FLYPMode is still an early prototype, and DARPA hasn't yet revealed whether the design will be altered, put into production, or even scrapped entirely. However, the main goal behind the crowd-sourced endeavor was to see how efficiently non-traditional military prototypes could be constructed, and in that respect, the FLYPMode is already a huge success.

Greater Manchester police have been accused of ending ?face-to-face access? for the public after the disclosure that many public service counters at police stations across the region face closure.
But the police minister, Nick Herbert, defended the move, saying contact time with the public could actually be increased if the police adopt innovative approaches, such as sharing community centres and shop premises, instead of retaining ?an attachment to old buildings?.
In the case of the Greater Manchester force, the alternative to the 20 public service counters that face closure appears to be a phone mounted on the outside wall of the police station with a direct line to a remote control room.
The Manchester police station closures follow last week?s announcement by the Met that half the 64 ?open all hours? police stations in London are to be closed to the public outside office?hours.
The row over public access came as Greater Manchester police confirmed that 900 officers and civilian staff are to lose their jobs in the second phase of cost-cutting at one of the country?s biggest forces. The force needs to find savings of ?134m over the next four years to meet the 20% cut in Whitehall police funding. It is expected to lose 3,000 of its 12,000 staff by 2015.
The jobs of 616 police staff and 270 officer posts are to include 55 front-desk jobs, crime scene forensic investigators, intelligence, serious crime and call-handling posts.
Peter Fahy, Greater Manchester?s chief constable, said: ?We are faced with a very difficult financial situation. We?ve looked at every single one of these areas to decide can we do it differently, can we centralise certain functions, do we need to be doing it at all? It has created opportunities but it?s been incredibly painful for the members of staff involved.?
A decision by the police authority to forcibly retire 169 police officers during this financial year has been postponed until August.
The Manchester announcement triggered a row at Westminster, where Labour MPs claimed the removal of ?face-to-face access with the public at police stations? was degrading a frontline service to the public. Graham Stringer, the Labour MP for Blackley and Broughton, said: ?If the police hide away behind locked doors, then it?s more difficult for them to know what is going on and to be an effective police force.?
But the police minister denied the charge and insisted the chief constable had made clear that the headquarters staff in Manchester had grown too big and savings could be achieved.
Herbert said: ?There are many innovative ways the police can make contact with their communities which don?t necessarily involve an attachment to old buildings, and actually there are forces which around the country do things like sharing community centres, sharing shop premises and actually increase the contact time they have with the public as a result.
?The number of visits to police stations can actually be very low.?
The first phase of Manchester?s police cuts saw savings of ?30m and the second phase is expected to amount to a further package of ?33m of savings.

The software is made possible with the creation of the programming languages that are most fitting to the design and interface of the program being created. There are many times that a single application can be created multiple language platforms.
But then again, all of these programs won?t be possible without the creation of an operating system. The operating system is the software by which a computer system runs. Popular examples of such software are the Windows platform, Linux, Unix, and Mac OS. There are a lot of old operating systems being used before and the most popular of which is DOS. The operating system serves as a good median for the computer and the processor?s language. Its main job is to translate every single program created for the operating system and allow the machine to process them accordingly, so that people can run and use the program.
The evolution of computer programming languages is required in this ever-changing world. It is mandatory that they have to keep up with the demands of the current times. Before, computers are used against a black, monochrome background. Right now, computers uses images, colors, and interactive icons. The contrast is very striking that you can just imagine what would happened if there were no evolution that happened.
The introduction of new computer programming languages should be a welcome addition to the growing group of computer languages. The new features and abilities these can be used widely in different applications are in currently in demand.
Now you can be a confident expert on Computer Programming. OK, maybe not an expert. But you should have something to bring to the table next time you join a discussion on Computer Programming.

Fuel costs weigh on Carnival's 2Q net income (AP)
NEW YORK ? A continuing battle with rising fuel costs, combined with political unrest in the Middle East and North Africa and the aftermath of Japan's earthquake and nuclear disaster, pushed Carnival Corp.'s net income down 18 percent in the second quarter.
The Miami cruise operator's quarterly performance beat analysts' expectations on Tuesday. The company also lowered its full-year earnings guidance below Wall Street's forecast mainly because of the bigger-than-expected impact of the Middle East and North Africa disruptions.
Climbing fuel prices have been a thorn in the side of cruise operators, airlines and other businesses. Carnival said higher fuel prices cost it about $150 million, or 19 cents per share, in the quarter. Fuel prices rose 35 percent to $673 per metric ton from $498 per metric ton a year earlier.
But fuel was not the only concern. Excluding fuel, net cruise costs increased 3 percent, with Senior Vice President of Finance and Chief Financial Officer David Bernstein saying during a conference call that Carnival is contending with increasing food costs, crew travel and other hotel costs.
Many businesses, like supermarkets and restaurants, are dealing with rising costs for food items, such as meats and corn. Better travel demand has also spurred higher hotel costs.
For the period ended May 31, Carnival earned $206 million, or 26 cents per share. That's down from $252 million, or 32 cents per share, a year earlier.
The result was still better than the 23 cents per share that analysts surveyed by FactSet predicted.
Carnival's stock gained $1.51, or 4.2 percent, to $37.24. The shares have traded from $29.68 to $48.14 over the past 12 months.
J.P. Morgan's Kevin Milota said in a client note that it was a good quarter for Carnival, but that the status of the overseas markets, volatile fuel prices and consumers' appetite for spending will remain variables.
Revenue rose 11 percent to $3.62 billion, exceeding Wall Street's estimate of $3.51 billion.
Carnival experienced strength in its North American brands, with revenue yields rising 3 percent. Revenue yields measure the amount a cruise company makes from its passengers after removing expenses.
While its European, Australian and Asian brands improved slightly, they were hampered by itinerary changes caused by events in the Middle East, North Africa and Japan.
The difficulties overseas are nothing new, as Carnival said in March that the problems in the Middle East and North Africa had led to slowing demand for itineraries there.
Vice Chairman and Chief Operating Officer Howard Frank said Tuesday that when Carnival gave its 2011 guidance in March the company "clearly underestimated the impact that the political unrest in the Middle East and North Africa would have on our business for the remainder of the year."
Carnival, whose brands include Carnival Cruise Lines, Holland America Line and Princess Cruises, now expects 2011 earnings of $2.40 to $2.50 per share. Previously, it expected between $2.55 and $2.65 per share.
For the third quarter, Carnival anticipates earnings of $1.60 to $1.64 per share.
Analysts forecast full-year earnings of $2.54 per share and third-quarter earnings of $1.74 per share.
The cruise operator maintained its position that advance bookings for the rest of 2011 show people are paying more for their cruises than last year but that occupancies are lower because of increased cruise capacity.
The economic recovery has allowed cruise operators to start raising ticket prices as people are again starting to spend more on travel.
Carnival operates 100 ships with eight new vessels set to be delivered between June and February 2015.
